Social Security Administration (SSA) survivor’s benefits are important economic resources for widows, widowers, and dependents. Until recently, these benefits could be hard for surviving partners of same-sex relationships to obtain. In this class, learn how to access SSA survivor’s benefits for same-sex couples.

Class covers:

  • The history of SSA policies that created a disparate impact for same-sex couples
  • Key cases and laws that affect SSA survivor’s benefits for same-sex couples
  • Common issues when a surviving partner requests survivor’s benefits
  • Who may be eligible for same-sex survivor's benefits
  • Timing and other factors when determining eligibility for same-sex survivor's benefits

John Miller is a Legal Help Desk Attorney at Lambda Legal, where he provides legal education services to members of the LGBTQ community and those living with HIV. John also teaches legal research to LLM and JD students as an adjunct lecturer of law at USC Gould School of Law and works with Native American tribes to promote access to justice.

Sarah Seville is a Help Desk Attorney at Lambda Legal, where she provides resources and legal education to the LGBTQ community, people living with HIV, and their families. Her previous adventures have included work at Equality California, the National Center for Lesbian Rights, the Harriett Buhai Center for Family Law, and the Ripped Bodice Bookstore.

LIVE ZOOM: MCLE: Representing Survivors in Housing Court

Tuesday, December 12, 2023: 12:00 p.m. – 1:00 p.m.

This one-hour training given by the Family Violence Appellate Project will help practitioners better represent survivors of gender-based violence facing eviction. Although this training covers multiple eviction defenses, it will focus on the Survivors’ Eviction Defense.  Expanded in 2023 and codified in Code of Civil Procedure §§ 1161.3 and 1174, the Survivors’ Eviction Defense protects tenants from being evicted because they experienced gender-based violence or another type of violent crime.

Class covers:

  • The dynamics of domestic violence
  • Eviction defenses
  • How the dynamics of domestic violence can impact representation.
  • Defenses for people getting evicted because they experienced abuse or violence
  • The expanded Survivors’ Eviction Defense (CA Code of Civil Procedure §§ 1161.3 and 1174)

Presented by Taylor Campion: Taylor Campion is the Senior Managing Attorney of the Family Violence Appellate Project’s (FVAP’s) Housing and Employment Justice Program and has been advocating for marginalized communities’ housing and economic rights since 2012. At FVAP, Taylor provides attorneys and advocates technical assistance and trainings on legal issues facing gender-based violence survivors, represents survivors in housing appeals and creates written legal tools that help survivors’ assert their housing rights. Taylor joined FVAP after working as a direct services attorney at Bay Area Legal Aid and Law Foundation of Silicon Valley. As a direct services attorney, she represented clients facing eviction, housing subsidy termination, housing discrimination and habitability issues and clients with SSDI and SSI claims. Taylor received her J.D. from the University of Utah and B.A. from Haverford College.

Technology has provided so many ways for attorneys to locate the best and most on point statutes, cases, secondary sources and other relevant materials that it can be a little overwhelming. The goal of this course is to assist attorneys in navigating the world of online legal research, so they can competently – and confidently – research the subjects important to their work. During this session we will review recent enhancements to the Lexis platform, the power of Shepards, as well as highlight research best practices for navigating Lexis.com.

Class covers:

  • Discover various methods for conducting research and when to use each.
  • Gain an understanding of how online platforms have been enhanced to predict what you’re looking for.
  • Ascertain the multiple ways to filter searches before and after inputting your search.
  • Discover different search term approaches: natural language and terms and connectors.
  • Understand the role technology plays in validating primary authority.

Implicit bias – a form of bias that occurs automatically and unintentionally – has an impact on people across the legal field, including judges, juries, clients, and attorneys. Everyday decision-making is unavoidably affected by implicit biases, stereotypes, and other types of cognitive biases. As attorneys, it is imperative that we understand these biases and take steps to ensure they do not have unfair or harmful consequences. The training will tackle intersectionality around implicit bias, and how attorneys can address implicit bias issues within themselves and the courtroom setting.

Class covers:

  • The attitudes and stereotypes that affect our understanding, actions, and decisions in an unconscious manner
  • Recognizing implicit bias in ourselvesour workplaces, and the courtroom
  • The concept of intersectionality, and why it is important to keep intersectionality in mind when addressing implicit bias issues
  • Specific techniques that can interrupt implicit bias in courtroom settings

Professor Christine Goodman joined the Pepperdine faculty in 2001. She teaches Evidence, Constitutional Law, Racial Justice, Trial Practice and Comparative Anti-Discrimination Law. Professor Goodman writes on equal protection topics, including implicit bias, algorithmic bias, affirmative action, preferences, diversity and racial privacy, as well as evidentiary and criminal law issues.

Vida Thomas is Managing Partner and Co-Owner of Oppenheimer Investigations Group.  Vida has conducted hundreds of workplace investigations, and teaches human resources professionals how to conduct effective workplace investigations. She also conducts inherent bias and diversity and inclusion training for private and public sector employers.

Los Angeles is facing a homelessness crisis and pro bono attorneys are needed to help prevent unjust evictions of low-income tenants. This training will provide an overview of the eviction process and outline current housing laws that protect tenants against eviction. After completing this training, attorney volunteers can join the We Are LA Pro Bono Project and partner with legal services organizations to provide free legal assistance to tenants facing eviction through clinics and full scope cases. Pro bono projects will provide volunteers the opportunity to practice landlord-tenant law and learn litigation skills while helping tenants navigate the eviction process.
