What You Need to Know About Government Filings and Loss of Attorney-Client Privilege

As part of the LA Law Library’s MCLE lunch hour speaker series, this class will focus on the loss of attorney-client privilege when administrative and other filings are made to the government. Many attorney-client communications can lose their privileged status upon filing related documents with government agencies, including bankruptcy petitions and schedules, and tax returns. Learn about the ramifications of this loss of privilege, including how attorneys should inform their clients to control the information flow to various professionals; consider a worst case scenario in which an attorney may be called upon to testify, and turn over documents; and, explore the dangers of inadvertent transition from counselor to co-conspirator.

  • Waiver of privilege upon filing of bankruptcy petition & schedules
  • Control of privilege by a bankruptcy trustee
  • Other privilege waiver upon government administrative filings

Presented by Curt Harrington
Curt Harrington is a high-tech patent attorney and a California Board of Legal Specialization Certified Tax Specialist. In addition to his J.D., Curt holds an LL.M. in tax and masters degrees in chemical and electrical engineering. He has prepared and prosecuted more than 100 patents, and has published and spoken widely on IP and tax issues. He is currently Vice-Chair of the California Board of Legal Specialization, and is knowledgeable in the area of intellectual property taxation.

Penny St. John is the founder of Conflict Resolution Management, and is both an experienced family lawyer and a certified mediator. A graduate of Stanford University and Boston University School of Law, Penny began practicing law at O'Melveny and Myers in Los Angeles before joining Trope and Trope, the largest and one of the most prestigious family law firms in California. She has worked successfully as a mediator since 1997.

Drafting and Service of Subpoenas: Testimony, Trial, and Federal Court Subpoenas

As part of the LA Law Library’s MCLE lunch hour speaker series, this class will provide an overview of the law governing those subpoena types not discussed at the popular April edition of this presentation. Attendees will gain a clearer understanding of how to properly draft and serve the various types of subpoenas, plus receive a free booklet of material including forms and the rules governing each type of request.

  • Deposition subpoena for personal appearance
  • Civil subpoena for personal appearance at trial or hearing, and the declaration in support
  • Federal subpoenas to produce documents; testify at a deposition; and, appear and testify at a hearing or trial

Presenter Jim Ayer is the Vice-President of Titan Legal Services and has been in the subpoena industry since 1997. He was previously the Office Manager for Whitmont Legal Technologies’ Subpoena Division as well as the division’s Senior Account Executive. In 2008, Jim along with his partner Jack Cambe formed Titan Legal Services, Inc. Since that time, Jim has been sharing his considerable knowledge of the subpoena process through subpoena training classes for various legal professional organizations throughout California.
