MCLE: How to Reach a Party or Witness in Another Country

Whether you are an attorney with a cross-border practice or an individual involved in a divorce or custody dispute with someone living in another country, this class will help you follow the specialized steps required to serve notice outside of the United States.

The Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters, more commonly called the Hague Service Convention, is a treaty that gives litigants a reliable and efficient means of serving documents on parties living, operating or based in another country. The provisions of the convention apply to service of process in civil and commercial matters but not criminal matters.

Class covers:

  • A brief introduction to what the Hague Convention is and when it applies
  • How to serve a party outside of the United States using the provisions of the Hague Convention
  • Alternatives means of service-of-process abroad under (1) Fed. R. Civ. P. 4.and (2) the Inter-American Convention on Letters Rogatory and Additional Protocol.
