Protecting Free Speech in the Courts: California’s Anti-SLAPP Statute

Tuesday, April 30, 2019:  1:30 p.m. – 2:30 p.m.

One way California protects your free speech and petition rights is through the anti-SLAPP (Strategic Lawsuit Against Public Participation) statute, Code of Civil Procedure § 425.16. This law protects against meritless lawsuits brought to intimidate and coerce those who exercise their First Amendment rights. Learn how the anti-SLAPP statute works and about some of the controversies surrounding the law.

Class covers:

  • What is a SLAPP (Strategic Lawsuit Against Public Participation)?
  • How the anti-SLAPP law protects free speech and petition rights under the First Amendment
  • The two-step analysis applied by courts in an anti-SLAPP motion
  • Why the law provides for attorney's fees to successful defendants, and other features of the law
  • Controversies surrounding the anti-SLAPP statute
